![]() Fishbowl shall make the purchased Fishbowl Services available to Customer pursuant to this Agreement and the relevant Order Forms, unless earlier suspended or terminated in accordance with this Agreement or an Order Form. Updates will not include any release, option, or future product that Fishbowl separately licenses.ġ.18 “Usage Limits” means usage parameters set forth in an Order Form, including concurrent or named User restrictions, as applicable.ġ.19 “User” means any person who is affiliated with Customer as (a) a full-time or part-time employee, or (b) a full-time or part-time consultant.ģ.1 Order Form. On top of that, they don't even integrate with any other POS programs or companies that work for basic retail applications, so we currently don't have an alternative.In addition to capitalized terms that are defined anywhere in this Agreement, the capitalized terms set forth below shall have the meanings set forth therein for the purposes of this Agreement and any Order Form in which such term is used but not defined.ġ.1 “Cloud Version” means the version of a Software Product made available to Users through the internet.ġ.2 “Customer” means the purchasing entity identified on the Order Form.ġ.3 “Date Purchased” means the purchase date or effective date identified on the Order Form.ġ.4 “Desktop Version” means the version of a Software Product that works outside the browser, as a standalone application.ġ.5 “Documentation” means the user guides and manuals for installation and use of a Software Product that Fishbowl makes generally available.ġ.6 “Equipment” means the Fishbowl hardware designated in a relevant Order Form, which Customer is purchasing pursuant to this Agreement.ġ.7 “Fishbowl Services” means Products, Support, Training, and related services, licensed or purchased pursuant to this Agreement and the relevant Order Form.ġ.8 “Hosted Services” means the Cloud Server/Hosting services designated in a relevant Order Form, which Customer is purchasing pursuant to this Agreement.ġ.9 “Intellectual Property Rights” means Fishbowl’s or its licensors’ patent, copyright, trademark, trade secret and any other intellectual property rights.ġ.10 “Order Form” means the standard Fishbowl form used for placing orders of Fishbowl Services, executed by Customer.ġ.11 “Products” means Software Products, Hosted Services and Equipment licensed or purchased pursuant to this Agreement and the relevant Order Form.ġ.12 “Software Product(s)” means software products owned or licensed by Fishbowl to which Fishbowl grants, if Desktop Version, a software license to download, install and use such Software Products in object code form only, or, if Cloud Version, the right to access and use, including Documentation and Updates, subject to the terms of the applicable Order Form(s) and this Agreement.ġ.13 “Subscription” means a subscription to the Software Products identified on the Order Form.ġ.14 “Subscription Term” means the term of a Subscription as set forth in the applicable Order Form.ġ.15 “Support” means certain support, maintenance, installation, implementation and related services made available by Fishbowl for applicable Products, or as designated in a relevant Order Form purchased by Customer.ġ.16 “Training” means the training services designated in a relevant Order Form, which Customer is purchasing pursuant to this Agreement.ġ.17 “Update” means a current release of the Software Product, which Fishbowl makes generally available for Subscriptions purchased by customers, unless otherwise set forth in this Agreement. It experiences all of the aforementioned issues but is also just a program that feels like they don't work towards improving at all. Speaking of the POS side, their "Checkout" program is not great at all. Our purchaser has also often been in the middle of a large PO, and the program freezes, requiring a restart and loss of that whole PO. Literally, on almost every transaction, their "Checkout" program freezes and they need to force quit and reopen. From what I have learned from support, the program does this on purpose to protect the database from data loss, but what it results in is our Sales guys needing to restart our POS program CONSTANTLY. Quite unfortunate.Īnother common issue that we face is the program's habit of freezing constantly. They are not always detrimental, but the accumulation of these small issues results in a program that you wouldn't believe costs what it does. Also, their kitting function is what we were originally sold on, but we have now completely stopped using the function because it has fundamental issues. We experience issues with basic things like scanning products, typing in fields, synchronizing inventory with our online store, etc. I do not like that we have paid over $30,000 for a program that has basic functionality issues. ![]()
